LIVE LOCAL ACT

Senate Bill 102, also referred to as the Live Local Act, was approved by Governor DeSantis on March 29, 2023, and became law on July 1, 2023. It was amended by Senate Bill 328, which became effective May 16, 2024.

The Live Local Act preempts a local government’s regulation on zoning, density, and height for certain multi-family and mixed-use affordable housing developments. The 2024 amendment includes some restrictions on qualifying developments, such as a prohibition of Live Local Act projects within ¼ mile of a military installation.

Live Local Act Projects must still satisfy the County’s Land Development Code regulations for multifamily developments in areas zoned for such use and otherwise be consistent with the Comprehensive Plan, with the exception of the statutorily preempted provisions establishing allowable densities, height, and land use.

At this time, the County will only consider the portion of a Planned Unit Development that is intended for Live Local Act Housing as eligible for the program.

A fully executed and recorded Land Use Restriction Agreement will be required to obtain final approval for the project.

STEPS TO APPLY

  1. Verify the proposed property is located within unincorporated Walton County in one of the following zoning districts:
    1. Commercial: General Commercial (GC), Neighborhood Commercial (NC), Business Park (BP).
    2. Industrial: Light Industrial (LI), Heavy Industrial (HI).
    3. Mixed-use: Rural Village (RV), Urban Residential (UR), Neighborhood Infill (NI), Small Neighborhood (SN), Traditional                  Neighborhood Development (TND), Coastal Center (CC), Coastal Center Mixed Use (CCMU), Coastal Village-1 (CV-1), Village Mixed Use (VMU), Town Center One (TC-1), Resort (R).
  1. Submit a pre-application form to Walton County Planning and Development Services for review to determine if the proposed project meets the criteria for the program.
  2. Complete the Live Local Act Verification form and include it with your pre-application.
  3. Additional steps, such as site plan review and building permitting process will be outlined during the pre-application phase.
